‘Crime 101’ Star Halle Berry Seeks Custody Restoration Amid Olivier Martinez Dispute
Halle Berry and Olivier Martinez have been embroiled in family court battles for years regarding their son, Maceo. The former couple, who met in 2010, ended their marriage in October 2015 after two years, and the custody issues that arose were only resolved in August 2023.
The agreement established joint legal custody, with Berry paying Martinez $8,000 monthly in child support, plus 4.3% of any income she earns over $2 million. This arrangement has faced numerous challenges, including Berry’s previous attempts to gain sole legal custody and her requests for the court to encourage Martinez to participate in co-parenting therapy.
Recently, the situation has escalated significantly. According to reports from Entertainment Weekly, Berry has responded to Martinez’s allegations of abuse against their 13-year-old son in a new court filing, instead accusing her ex of alienating Maceo from her.
In documents submitted to Los Angeles Superior Court on Monday, October 5, Berry requested the judge to reinstate the 50-50 custody agreement established in 2023, regain authority over parental decisions, and mandate that Martinez return to counseling.
Her filing outlines several concerns regarding Martinez’s behavior, including claims that he places Maceo in the middle of their conflicts, disrupts her therapeutic efforts with their son, and attempts to align Maceo against her.
Berry also alleges that Martinez has tried to sway Maceo’s teachers and therapist against her. She notes that Maceo often returns from visits with his father feeling angry and combative, sometimes echoing private disputes between his parents.
Another concern raised by Berry involves her partner, Van Hunt. She states that Martinez refuses to acknowledge her relationship with Hunt, who she claims plays a significant role in Maceo’s life. Berry also asserts that therapy has positively impacted Maceo’s behavior at home and with her.
This new filing comes shortly after Martinez sought sole custody and a restraining order. On October 1, he accused Berry of physically assaulting Maceo during a confrontation at her home on September 26.
A Los Angeles judge partially granted Martinez’s request, reportedly limiting Berry’s court-ordered time with Maceo to daytime visits while the custody case is ongoing. Fiction Horizon notes that Berry’s latest filing did not directly respond to Martinez’s abuse allegations.
Berry has categorically denied these accusations. Her attorney, Marina Beck, described Martinez’s filing as meritless and misleading, claiming he has repeatedly violated court orders and disrupted therapeutic and educational interventions involving Maceo.
Martinez has responded by asking the court to reject Berry’s request entirely, citing the temporary restraining order currently in effect and expressing concerns about potential immediate danger to their son. He also contends that Berry improperly filed an emergency request instead of a standard one.
Martinez’s attorney, Patrick Baghdaserians, stated that Martinez’s primary concern is Maceo’s health, welfare, and safety, emphasizing his focus on protecting him. It is important to note that all claims in this case remain allegations, and no court has made definitive findings.
Currently, both parties are at opposing ends of a deeply personal dispute. Berry is advocating for the restoration of the custody arrangement they agreed upon in 2023, while Martinez is pursuing sole custody.
The case is set to return to court, where a judge will consider the conflicting requests. Until then, the filings from both sides provide insight into a long-standing conflict that has intensified in recent weeks.
