The ongoing custody dispute between Halle Berry and Olivier Martinez has garnered significant public attention over the years. Recently, text messages exchanged between the two have surfaced, adding a personal dimension to this already complex situation. It is important to note that the allegations mentioned have not been substantiated, and both parties have presented their perspectives.

Berry initiated divorce proceedings in October 2015, and by August 2023, the former couple had established a split-custody agreement. This arrangement allows them joint legal custody of their son, with Berry contributing $8,000 monthly in child support. However, Berry has since sought sole legal custody, claiming that Martinez does not engage in co-parenting in a manner that prioritizes their child’s needs, while Martinez has accused her of exploiting the situation.

The latest developments began when Martinez, 60, filed for a temporary restraining order against Berry, also 60, as reported by documents obtained from People. He alleges that on September 26, Berry physically assaulted their 12-year-old son by choking him during a dispute that arose while he was playing a virtual reality game. Martinez claims this incident is part of a larger pattern of conflict that has persisted over the years.

In his petition, Martinez is requesting sole legal and physical custody of their son, citing a history of physical, verbal, and emotional abuse. Berry’s representatives contest these claims.

Martinez’s filing includes screenshots of text conversations between him and Berry. According to People, these messages were sent around the time of the alleged incident. In them, Berry expresses remorse for the previous night’s events and suggests that their son feels similarly.

Other messages reveal a more nuanced situation. Martinez reportedly stated that he was unaware of the circumstances and claimed that Berry and their son often have conflicts. In one message, Berry allegedly expressed feelings of disrespect from her son and discomfort with him staying with his father. On September 27, she reportedly reached out to Martinez for assistance in communicating with their son.

Berry’s attorney, Marina Beck, has categorically denied the allegations. She asserts that there is substantial evidence, including several judicial rulings, indicating that Martinez has violated court orders and disrupted therapeutic and educational efforts for their son. Berry’s legal team also argues that the text messages reflect regret over a serious verbal disagreement rather than an admission of physical wrongdoing.

Martinez’s attorney, Patrick Baghdaserians, refrained from commenting on Berry’s team’s statements, emphasizing that his client’s primary concern is the health, welfare, and safety of their child.

On Thursday, October 1, a Los Angeles County judge approved the temporary restraining order and adjusted the custody arrangement. Berry is now required to maintain a distance of 100 yards from Martinez, with her contact with their son limited to court-ordered visitation. The court denied a request to sever all contact between mother and son, determining that continued visitation is currently in the child’s best interest.

The judge also declined to impose monitoring of Berry’s sobriety, citing a lack of sufficient information. This temporary order will remain in effect until a hearing later this month, when the court will decide if it should be made permanent. Until then, the allegations remain unproven, and the case is unlikely to reach a resolution in the court of public opinion.
