A lawsuit initiated by Texas Attorney General Ken Paxton has brought serious allegations against Netflix regarding its data collection and usage practices, particularly concerning children. Filed in Collin County state court, the case scrutinizes the streaming giant’s data practices and platform design.

Paxton asserts that Netflix has been collecting extensive information about its users without obtaining proper consent. This includes data on viewing habits, device specifics, and other behavioral information linked to both adult and children’s profiles.

In a statement accompanying the filing, he remarked, “Netflix is not the ad-free and kid-friendly platform it claims to be. Instead, it has misled consumers while exploiting their private data to make billions.”

Netflix has categorically denied these allegations. A spokesperson for the company stated that the lawsuit is based on inaccurate information and defended Netflix’s privacy policies. They emphasized, “Netflix takes our members’ privacy seriously and complies with privacy and data-protection laws everywhere we operate.” The spokesperson also noted that the company offers “industry-leading” parental controls and transparent privacy tools for users.

The lawsuit claims that Netflix operates what it describes as a “surveillance machinery,” allegedly tracking user behavior across various profiles, including those of children. The filing indicates that this system gathers information on what users watch, the devices they utilize, and their interactions with the platform. It also suggests that Netflix has shifted its public image over time, evolving from a straightforward entertainment service into a significant data-driven entity.

Paxton’s filing criticizes features such as autoplay, arguing they are designed to prolong user engagement. The lawsuit contends that these design choices are intended to enhance user retention in ways that financially benefit the company. Furthermore, it claims that Netflix presents itself as child-friendly while still collecting and analyzing data from younger audiences.

Netflix is not alone in facing scrutiny over its data practices; other tech companies, including social media platforms and streaming services, have also been challenged in court regarding similar issues related to user tracking and platform design.

The lawsuit alleges violations of the Texas Deceptive Trade Practices Act and seeks penalties, a jury trial, and an injunction to halt certain data collection practices. The case is now set to proceed through the Texas court system as both parties prepare to present their arguments.
